Board Requirements

An ordinance of the city of DeLand, Florida, amending chapter 33 of the code of ordinances of the city of DeLand, "land development regulations," article 11, "board and committees," by amending the residency requirements for members of the Historic Preservation Board; providing for severability and an effective date.

Be It Ordained by the City Commission of DeLand, Florida:

Section 1

Chapter 33 of the Code of Ordinances of the City of DeLand (the "Code") is hereby amended by amending Chapter 33, Article 11, Section 33-123 (A)(2), regarding residency requirements for members of the Historic Preservation Board to read, in full, as follows:

  • (2) At least four of the seven members shall be residents of the City of DeLand. Three of the seven members may be non-residents who own land in the Historic District.

Section 2

If any section, sentence, clause or phrase of this Ordinance is held to be invalid or unconstitutional by any court of competent jurisdiction, that holding shall in no way affect the validity of the remaining portions of this Ordinance.

Section 3

All ordinances, or parts of ordinances, in conflict herewith are, to the extent of such conflict, hereby repealed.

Section 4

This Ordinance shall become effective immediately upon its adoption.
